All BB Members, *Can someone please take the lead on organizing the Black Bear photo for the Sarris contest?* I just need to move that off of my plate at least until after Wednesday. I would still be be open to actually taking the photo or bringing some props perhaps on Thursday or Friday, but I just don't have time until then. Jason from Black Bear requested that we *contact Mr. Sellaro* who owns/leases the property by asking: Can somebody from your board contact Jim Sellaro for permission? I will contact Jim and let him know to expect a call. He runs Sellaro Overhead Door service in Star City. Also, Damien Davis asked yesterday: Are you taking the lead on getting the photo taken at Black Bear? If so, will you *contact Aaron Stout* (412-287-1512). Pennington, Robert; Brisendine, Rhonda K; Davison, Rebecca A; Dougherty, Cindy A; Carr, Brian A *Subject:* DOH Grant Application Website The West Virginia Division of Highways (WVDOH) is pleased to announce the opening of its electronic application system for the submission of FY2013 grant applications, a two-phase process consisting first of an Intent-to-Apply and, upon WVDOH acceptance of the Intent-to-Apply, a more detailed Application package. At this time you will only be able to complete and submit your Intent-to-Apply. The Application package is still under development, but will become available later in the fall as organizations complete and submit their Intent-to-Apply forms and receive authorization to complete and submit an Application package. As some of you may be aware, a new transportation bill (Moving Ahead for Progress in the 21st Century, or MAP-21) was enacted this summer resulted in deep changes to the WVDOH’s non-traditional grant programs. While WVDOH staff has read and attempted to interpret MAP-21, guidance has not yet been distributed by the Federal Highway Administration (FHWA). This has required the WVDOH to take a very conservative approach to the new bill; please be aware that future state and federal interpretations of MAP-21 may require revisions be made to WVDOH policies and procedures that are presently reflected in the Intent-to-Apply form. The important changes that an organization needs to be aware of before beginning the application process are: The Safe Routes to Schools Program (SRTS), which was a 100% federal program requiring no local funds, has been eliminated. A new eligible category under the Transportation Alternatives Program (more on that later) has replaced the SRTS program. Be aware that this now means, if you apply under the Transportation Alternative category similar to the former SRTS Program, a grant award must be matched at an 80/20 ratio, requiring a local match. The Transportation Enhancement Program (TE) has been replaced by the Transportation Alternative (TA) Program. TE-eligible categories have changed as well. “Funding for Bicycle and Pedestrian Education”, “Acquisition of Scenic or Historic sites” and “Transportation Museums” are no longer eligible categories. The MAP-21 TA eligible categories include: ‘‘(A) Construction, planning, and design of on-road and off-road trail facilities for pedestrians, bicyclists, and other non-motorized forms of transportation, including sidewalks, bicycle infrastructure, pedestrian and bicycle signals, traffic calming techniques, lighting and other safety-related infrastructure, and transportation projects to achieve compliance with the Americans with Disabilities Act of 1990. ‘‘(B) Construction, planning, and design of infrastructure-related projects and systems that will provide safe routes for non-drivers, including children, older adults, and individuals with disabilities to access daily needs. ‘‘(C) Conversion and use of abandoned railroad corridors for trails for pedestrians, bicyclists, or other non-motorized transportation users. ‘‘(D) Construction of turnouts, overlooks, and viewing areas. ‘(E) Community improvement activities, including— ‘‘(i) inventory, control, or removal of outdoor advertising; ‘‘(ii) historic preservation and rehabilitation of historic transportation facilities; ‘‘(iii) vegetation management practices in transportation rights-of-way to improve roadway safety, prevent against invasive species, and provide erosion control; and ‘‘(iv) archaeological activities relating to impacts from implementation of a transportation project eligible under this title. ‘‘(F) Any environmental mitigation activity, including pollution prevention and pollution abatement activities and mitigation to— ‘‘(i) address stormwater management, control, and water pollution prevention or abatement related to highway construction or due to highway runoff; or ‘‘(ii) reduce vehicle-caused wildlife mortality or to restore and maintain connectivity among terrestrial or aquatic habitats.’’ The Recreational Trails Program is the least changed of the WVDOH non-traditional grant programs. The major changes are that all grant funding is now lumped together under the TA Program when apportioned by the Federal Highway Administration; a portion is then set aside for the Recreational Trails Program (while the remaining Transportation Alternative Program funding goes to the other types of Transportation Alternative projects). The application process itself has also changed. There is now one Intent-to-Apply format and one Application format. You will be asked if you are applying for Recreational Trails Program funding; if that box is checked, then a set of questions relating only to that program will appear. If you do not check the box, the application is recognized as a Transportation Alternative project. In addition, the eligibility of organizations that have applied to the WVDOH non-traditional grant programs in the past has changed considerably. Eligible organizations include: local governments; regional transportation authorities; transit agencies; natural resource or public land agencies; school districts, local education agencies, or schools; tribal governments; any other local or regional governmental entities with responsibility for or oversight of transportation or recreational trails (other than a metropolitan planning organization or a state agency) that the state determines to be eligible. The most significant change is that the State DOT, state agencies in general and non-profits may no longer be eligible sponsors. The WVDOH encourages organizations that now find themselves ineligible under MAP-21 to partner with organizations that are eligible; this is the only way that ineligible organizations under MAP-21 can continue to participate in the non-traditional grant programs. There is only one set of dates for the submission of the Intent-to-Apply and the Application package: all Intent-to-Applies will be due by November 15, 2012, and all Application packages will be due by February 15, 2013. Change BB status on TC

Bicycle Board Members, At next Wednesday's Traffic Commission meeting, Christiaan Abildso, Pedestrian Safety Board Chariman will propose to the Traffic Commission to change it to the Transportation Commission and to make the Pedestrian representative (Christiaan) and Bicycling representative (me) voting members. We are currently ex-officio. Attached are a memorandum that he wrote explaining this and an ordinance that defines the Transportation Commission that should replace the ordinance that defines the Traffic Commission. We can discuss this at next week's BB meeting if you like. If I receive no response from BB members about this message or the attachment, we will assume that the BB concurs. Frank D. Bike rack approved

Bicycle Board Members, Jack Watson, Matt's dad called me tonight to say that Suncrest Middle School principal Napolillo agreed to install a bike rack at the school once the City erects appropriate School Zone signs around the school. A few weeks ago, Damien informed me that the City will do that. Napolillo agreed to put the rack in front of the school but not until the School Zone signs are up. Until then, the rack must be stored in back of the school. Jack will pick up the rack from Positive Spin in a couple weeks. Recently, the principal invited Matt to present his proposal to the school's LSIC (Local School Improvement Council, http://wvde.state.wv.us/lsic/ ). Matt won them over. Next, Napolillo took the proposal to Mon County Schools Superintendent, Frank Devono. Devono took it to a lawyer. The lawyer is drafting a waiver for parents to sign if they allow their kids to ride to school. (Jack will send me the waiver when he gets it. Since this is coming from Devono, it should work for all the schools!) Also, Napolillo will require that each bike parked in the rack have a permit to park in it. The details on this still need to be worked out. Thanks to the initiative, diligence, persuasiveness and perseverance of eighth grader Matt Watson, barriers to kids riding to school that apparently have been up since Jonathan Rosenbaum was a boy are being relentlessly broken down. A cause for celebration, I'd say! Frank

Don't you think this is worth a donation of at least one race entry fee? 4ank Dominion Post, Sept. 28, 2012 p. 7-A Teacher running so students can ride BY CHELSEA FULLER The Dominion Post For Mark Thorne, a special education teacher at South Middle School, the work doesn’t end when the bell rings at 2:20 p.m. As the sponsor of the school’s bike club, Thorne has decided to run so that his students can ride. To raise funds for the bike club, Thorne started a pledge drive as he prepares to run in the West Virginia Trilogy, Oct. 12-14, at Spruce Knob in Seneca Rocks Recreation Area, he said. “The fundraiser is being done this way so that kids don’t have to go door-to-door and raise money for their club,” Thorne said. “I am going to run all three days of the trilogy, totaling 94.1 miles. I am asking for people to sponsor me, and all proceeds will go toward our bike club.” The first day of the Trilogy is a 50-kilometer run, Thorne said. The second day is 50 miles and the final day winds down with a 13.1-mile run. “We cross over the highest point in the state right about daybreak. The fast runners finish the runs in the daylight, but I will finish with a headlamp on,” Thorne said with a laugh. There is no set pledge amount. People are welcome to pledge cents-permile or single monetary donations, Thorne said. Pledges are due before Monday, but donations can also be made after the race. “All funds raised from the pledge drive will be used to purchase helmets, T-shirts and equipment needed to repair bikes,” Thorne said. “We have had several people even donate bikes.” The South Middle School Bike Club, now in its third year, meets every two weeks rain or shine, and has 42 student members, officials said. “We’ve grown in popularity. Several of the students don’t have the opportunity to do other extracurricular activities,” Thorne said. Club member Shyan Weaver, 12, has used a wheelchair since she was a young child. The sixth-grader rides a custom-made bike with three wheels and a hand crank that propels the bike instead of pedals, she said. “Riding isn’t hard for me. The hills can be tough sometimes, but it’s not that big of a problem.” Weaver said being in the bike club has been a great experience for her. “I have only had one ride so far, but I am looking forward to the next one.” Bike club members are scheduled to take their next ride at 2:30 p.m. Oct. 4. They will ride from the school to Star City and back, Thorne said. Help with bike trail network project

I believe Colin expressed interest in creating a network of off-road bike trails in the area. Having just returned from a little slice of Utopia - Park City - I am inspired to make Morgantown much more mountain bike friendly. I am friends with an accountant with Bikes Belong in Colorado who formerly worked with IMBA. I contacted him to ask for some contacts/consultants to assist. I think we may be able to get some funds through the MPO to pay for such a consultant to come in to help. I'd like to offer to help by making these connections if there is interest. What a great network of singletrack riding/running/hiking we could have...damn Park City! Ride on, Christiaan

Farmer's Market Place Bicycle Parking

Does anyone know if the Bicycle Parking we requested will be installed at the new Market Place? Looking at the cam at http://axis-724d19.axiscam.net/view/index.shtml it is clear there is no parking at the front of the facility where one would have expected it. I am making the assumption that given that the facility was just built that parking hasn't been installed, yet. Correct? -Jonathan

(Recall that in her white paper, she gave two examples: 3 foot passing law and a self-imposed tax on biking community.) Well, I've given it some thought and wrote the attached document. Please read it and tell me what you think. Feel free to mark it up using track changes and comments and return it to me. Also, check In it, I am recommending 4 legislative changes: Repeal 17C-11-5 (a) which requires bicyclists to ride as near to the right side of the roadway as practicable. Or, if not repeal, add exceptions such as when preparing to make a left turn, to avoid hazards such as debris, glass, holes, dogs, etc. and when the road is too narrow for a bicycle and vehicle to travel safely side-by-side within the lane. Repeal 17C-11-5 (c) which says, whenever a usable path for bicycles has been provided adjacent to a roadway, bicycle riders shall use such path and shall not use the roadway. Amend 17C-7-3 which addresses overtaking and passing to require motorists to allow 4-feet when passing a bicyclist and to pass at a prudent reduced speed. Adopt the 2009 MUTCD. As you know, I have always resisted messing with legislation because I think most people and perhaps especially legislators hate bicyclists so once they turn their attention on us, we can only but lose out; especially competent bicyclists that operate their bicycles as vehicles. All 50 states have a law that says every person operating a bicycle upon a roadway shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a vehicle. Considering the level of bicycle friendliness that WV government has demonstrated, I wouldn't be surprised if WV were the first state to repeal that law or modify it so that we're not allowed on the roads anymore. Nevertheless, there seem to be more and more well-meaning people who are not competent bicyclists promoting new laws and changes to existing laws so I feel compelled to be proactive rather than reactive. Kasey is a Charleston City Councilor and an experienced lobbyist. I think she's capable of getting something good done for WV bicyclists. She told me that she was 5 years old when she last rode a bike and she's afraid of bicycles. I'm sure she's getting legislation recommendations from all over the state. Since we're one of the few places in WV that has an organized body of bicycling experts, i.e. the BB, our recommendations might get attention.
