The Rainforest Action Network hung a huge banner off a crane in front of the Bank of America building that dominates the skyline of downtown Charlotte. The sign read, "Financing Coal, Killing Communities." Many of us are not aware of all the mining practices of coal giants such as Arch Coal and Massey Energy. Besides the familiar underground mining, they blow up mountains in Appalachia to get down to the coal, and push the waste and debris into surrounding valleys. Known appropriately as mountaintop removal, this practice has leveled more than 470 Appalachian mountains and buried or polluted thousands of miles of mountain streams -- streams at the headwaters of the drinking water supply of millions of Americans. Blasting and flooding from mountaintop removal are also devastating families and communities in the mountains and leaving the economy of central Appalachia in shambles. Robert F. Kennedy Jr., perhaps the most prominent environmentalist of our time, recently stated in a speech in Blowing Rock, "Mountaintop removal is the biggest environmental battle of our hemisphere. You know, you can restore the Hudson River in perhaps a hundred years. But you will never, never, get these mountains back. This is truly a crime against every human being in the world." Duke wants huge new plant Another prominent corporation in Charlotte, Duke Energy, is closely connected to Kennedy's concerns. Duke is trying to gain state approval for a huge coal-fired power plant just upwind from Charlotte. The smaller, existing plants at this Cliffside site use mostly mountaintop removal coal from West Virginia and surrounding states, and the much larger unit, if approved, is expected to burn coal from the same region. In fact, according to the Boone-based environmental organization Appalachian Voices, Duke Energy is one of our nation's three biggest users of mountaintop removal coal.Not only would increased demand for coal from the expanded Cliffside plant lead directly to the destruction of more beautiful and irreplaceable Appalachian mountains and communities, it would add millions of tons of global warming gases and other pollutants to our atmosphere. Congressional efforts to curb global warming are very likely to succeed in what promises to be a much more environmentally concerned Congress. So the Duke Energy effort to gain approval for the Cliffside coal plant may be seen as a race against time to get what may well be one of the last of the dirty coal plants in under the wire. When Congress does finally act to regulate global warming gases, those regulations will be costly for states like North Carolina that get most of their electricity from dirty coal plants. With an astronomical 61 percent of our electricity already generated by burning coal, North Carolinians have a lot to lose by putting even more of our energy "eggs" in the coal "basket." Rhetoric misleading Another connection exists between Bank of America and Duke Energy: both claim to be responsible corporate citizens who are concerned about their environmental footprint. Bank of America claims to be investing heavily in technologies that will reduce global warming. However, in 2006 the company spent $100 on dirty energy projects for every dollar it spent on clean energy, according to a white paper by the Rainforest Action Network. The environmental rhetoric of Duke CEO Jim Rogers is just as misleading: Rogers asserted in a recent editorial in The New York Times that the best power plant is the one you don't have to build. But a recent study by the N.C. Utilities Commission demonstrated unequivocally that conservation, efficiency and renewables could meet North Carolina's projected energy demand at a comparable cost to what Duke plans to spend building the Cliffside coal plant. The motto of North Carolina is Esse Quam Videri -- "To be, rather than to seem." HANLEY The Associated Press Monday, October 22, 2007; 2:26 PM -- The proliferation of coal-burning power plants around the world may pose "the single greatest challenge" to averting dangerous climate change, an international panel of scientists reported Monday. Governments and the private sector are spending too little on research into a partial solution _ technology to capture and store the carbon dioxide emissions from such plants, the group said. The study by 15 scientists from 13 nations, "Lighting the Way: Toward a Sustainable Energy Future," was commissioned by the governments of China and Brazil and is the product of two years of workshops organized by the InterAcademy Council, the Netherlands-based network of national academies of science. The 174-page report details current and developing technologies, and government incentives and other policies that could lead both the developed and developing world to clean, affordable and sustainable energy supplies. "The first thing it says, really, is that conservation and energy efficiency will remain for the next couple of decades the most important thing the world can do to get on a sustainable path," said co-chairman Steven Chu, Nobel Prize-winning physicist and director of California's Lawrence Berkeley National Laboratory. Such steps are urgently needed, the panel said, not only to cut back emissions of carbon dioxide and other gases blamed for global warming, but also to extend basic energy services to 2 billion poor people worldwide and reduce the potential for international conflict over energy resources. The report took note of the growing role of coal-fired power plants in some countries, "despite increased scientific certainty and growing concern about climate change." China expects to open one new coal-fired plant per week over the next five years. In the United States, plans for more than 150 new coal plants have been announced since the late 1990s, although some recently have been scrapped or delayed because of climate and other concerns. European and U.S. scientists and engineers are working to develop capture-and-storage technologies, whereby power plants' carbon-dioxide emissions might be sequestered long-term in abandoned oil wells or other underground cavities. But the InterAcademy Council panel said such work is poorly financed. "Some would argue this is an absolutely cornerstone policy with currently inadequate investment and attention," panelist Ged Davis, a British energy economist, told reporters in a teleconference Monday. The report noted public investment worldwide in energy research and development was estimated at $9 billion in 2005. That should be at least doubled, it said, and there should be "worldwide introduction of price signals for carbon emissions," to push future public and private investment in a carbon-saving direction. Under the Kyoto Protocol, which requires emissions reductions by industrialized nations, the European Union operates a "carbon price" system whereby industries not using up their quotas can sell allowances to others that overshoot their quotas. The United States rejects the idea of such mandatory emissions cutbacks.

TRAILCO - Discovery of Carbon Foot Print for Proposed Electric Line

W. Va. Code § 24-2-11a (d)(1) provides with regard to proposed electric transmission lines, that "the commission may approve the application if it shall find and determine that the proposed transmission line: (1) Will economically, adequately and reliably contribute to meeting the present and anticipated requirements for electric power of the customers served by the applicant or is necessary and desirable for present and anticipated reliability of service for electric power for its service area or region; and (2) Will result in an acceptable balance between reasonable power needs and reasonable environmental factors." I have prepared a discovery request that seeks to flush out the environmental costs vs the electricity benefits for this specific proposed line. As currently drafted, the discovery request focuses almost exclusively on carbon dioxide emissions. Please review the proposed discovery request and forward me your suggestions for additions, deletions, changes. I would appreciate in particular any identifiable environmental costs other than carbon dioxide emissions, i.e., endangered species harm, adverse air or water impacts (and a means of quantifying them) and anything else that can be reduced to numbers. Bremby, Secretary of the Kansas Department of Health and Environment (KDHE), announced today that he has denied the air quality permit for the two proposed 700-megawatt generators at the Sunflower Electric Power Corporation plant near Holcomb. “After careful consideration of my responsibility to protect the public health and environment from actual, threatened or potential harm from air pollution, I have decided to deny the Sunflower Electric Power Corporation application for an air quality permit,” said Bremby. In making his decision, Bremby cited the authority provided to the Secretary of KDHE in K.S.A. 65-3008 and K.S.A. 65-3008a, which grant him the authority to affirm, modify or reverse a decision on an air quality permit after the public comment period or hearing, and K.S.A. 65-3012, which authorizes him to deny or modify an air quality permit to protect the health of persons or the environment. “I believe it would be irresponsible to ignore emerging information about the contribution of carbon dioxide and other greenhouse gases to climate change and the potential harm to our environment and health if we do nothing,” said Bremby. The U.S. Supreme Court found in Massachusetts v. EPA that carbon dioxide meets the broad definition of an air pollutant under the Clean Air Act. The Kansas Air Quality Act similarly has a broad definition of what constitutes air pollution. The Centers for Disease Control and Prevention has recognized the need for public health agencies to take the lead on educating the public about the health impacts of climate change and has adopted priority health actions to prepare for, respond to and manage the associated health risks of climate change. The decision constitutes a first step in emerging policy to address existing and future carbon dioxide emissions in Kansas. “ KDHE will work to engage various industries and stakeholders to establish goals for reducing carbon dioxide emissions and strategies to achieve them. This is consistent with initiatives underway in states leading the effort to address climate change,” said Bremby. One such initiative currently being undertaken by eight northeastern states is the Regional Greenhouse Gas Initiative (RGGI), a mandatory regional cap-and-trade program aimed at reducing carbon dioxide emissions from power plants by 10 percent, or approximately 12 million tons annually, by 2020. Sierra Club Wins One in Iowa

Coal-Fired Power Plant Blocked in Iowa DES MOINES, Iowa, October 15, 2007 (ENS) - Opponents of a new coal-fired power plant proposed in Waterloo, including the Sierra Club and the Iowa Farmers Union, celebrated a victory Thursday when a state panel rejected the City of Waterloo's request to annex land for the plant. The City Development Board decided that the annexation of land owned by residents who oppose the annexation did not meet the state guidelines for approval. Hundreds of citizens protested the annexation at a hearing in September. LS Power is proposing the $1.5 billion, 750-megawatt plant to serve up to 500,000 homes, some of which may be out of the state. "It was clear that this annexation was not in the public interest," said Carole Yates of the Cedar Prairie Group of the Sierra Club. "Coal-fired power plants are the largest source of global warming in the country and this proposal was a collection of worst practices - for our energy system, for our economy, for the environment, and for our community." The annexation proposal came before the City Development Board because a landowner, retired farmer Merle Bell, is standing against the plant. Last month more than 500 people rallied at Bell's farm in support of Bell and against LS Power. His farm has been in his family for more than a century. "I've lived on this land all my life," says Bell. "I promised my father I'd never sell the farm and I don't want to sell." Bell was joined in opposing the annexation and development of the site by neighbor Phyllis Morgan and 17 farmers who are opposed to plans for transmission lines across their land. The farmers' resistance attracted the attention of Iowa Farmers Union, which officially opposes the plant. "We have concluded that farmers benefit more from farm-based renewable energy than from giant new coal plants. We consider plants like this a threat to a sustainable, farm-based rural economy," said Gregg Heide of Pomeroy, board member of Iowa Farmers Union. Sierra Club and the citizen advocacy group, Community Energy Solutions, represented by nonprofit law firm Plains Justice, filed briefs against the proposal. "This is the beginning of the end for LS Power in Iowa," said Sierra Club organizer Mark Kresowik. "States across the country are recognizing the dangers of overdependence on coal and have rejected new plants. It's time for Governor Culver to truly embrace energy efficiency and renewable energy and say no to more dirty coal." The lack of annexation approval may not mean the end for this project as the city can reapply with a different configuration of land to be annexed. LS Power Project Manager Mark Milburn said the vote does not derail the project, which could go on even without annexation. But the utility wants to pay taxes to the city, and it makes sense to add the land to the already developed nearby industrial park, he said. Florida, Oklahoma, Delaware, Idaho, and California have rejected new coal plants in favor of cleaner energy options in the past 12 months.

PSC hearings phone bank

Some of the students have tentatively agreed to help out with phone banking to our members next Wednesday, Oct. 17 from 6-8 PM. We need to get a list of members in Monongalia, Preston, Marion, Taylor, Tucker, Grant, Hardy, and Hampshire Counties, as well as their phone numbers (specifically avoid those who have asked not to be called. I will prepare a simple script along the lines of: "Hi, I am ___ and I am calling on behalf of Sierra Club. We want you to come to a public hearing to speak against the proposed Allegheny line. The hearings are ..... Dates, times, locations, etc.... Can we count on you to join us? Would you be able to bring friends?, etc. etc. Is that date OK? Does anyone have a suggestion on where to do this? Any other volunteers? (I said I would bring a pizza). The first hearing is the following week, Oct. 23 in Morgantown, so we need to get started. There were two columns in the Gazette this week that CTL is the wrong way to go, but apparently Rockefeller has not gotten the message. The requirement for carbon capture may make this moot, but it is still a dangerous precedent. See story below from Huntington News Net. JBK ***** Oct. 6, 2007 Finance Committee Endorses Rockefeller Coal-to-Liquid Development Proposal By HNN Staff >From Senator Rockefeller's Office Washington, DC (HNN) – Late last night, Senator Jay Rockefeller (D-WV) brokered an agreement with members of the Senate Finance Committee to keep the development of coal-to-liquids (CTL) technology advancing in the right direction. “Many of us have come to understand that a responsible energy policy requires us to harness all of our abundant natural resources, including coal, and to demand and help spawn clean technologies. Clean coal-to-liquids conversion can and should play a big part in achieving energy independence that is so critical to our national security,” Rockefeller said. Specifically, Rockefeller worked with his colleagues to extend the alternative fuel tax credit for CTL development for three more years. To qualify, developers will need to demonstrate that they can capture 50 percent of the carbon emissions from a CTL facility over the next two years; then 75 percent by 2010. The agreement was reached as part of the Finance Committee’s deliberations on a major agricultural assistance bill that included tax incentives aimed at spurring rural development. The bill also includes tax incentives aimed at other alternative fuel research, such as ethanol and other biofuels, natural gas and wind power. “There is no single alternative fuel source that will address our growing energy needs and lessen our dependence on foreign sources of energy. We need to be investing in every solution and hold every solution to a high “green technology” standard. The responsible use of clean coal to meet our electricity and transportation needs must be in the mix,” Rockefeller said. “By including coal-to-liquids in this bill, we’re sending a signal to Wall Street and investors that coal conversion is a technology worth investing in.” Senator Rockefeller has long-supported efforts that would promote CTL development and believes CTL can and must meet high environmental standards. As part of the Senate debate on the Energy Act of 2007, Senator Rockefeller supported efforts to begin a substantial federal government investment – along the lines of the Apollo space program – to begin researching and developing a workable carbon capture and sequestration solution. Additionally, he’s working on legislation that would create a Future Fuels Corporation – a large scale joint government and private effort to finally solve carbon capture. Rockefeller noted that the ability to capture industrial carbon emissions will be the challenge of the coming decades and is crucial to addressing the problem of global climate change. Rockefeller also promoted CTL development in legislation he authored earlier this year to reauthorize the Federal Aviation Administration. The Senator is advocating for the creation of a national center of excellence to develop coal-to-jet fuel technologies. PSC Public hearings

As of 5 PM Tuesday, no additional info on public hearings has been filed on the PSC web page. The order from last Thursday calls for FOUR hearings to be held between Oct. 8 and Oct. 19 "or as soon thereafter as can be accommodated". The hearings will be held before an Administrative Law Judge, not the Commissioners. Hearings will be held both during the day and in the evening to accommodate those who wish to attend. This makes it easier for some people, but it means getting people to both the day and the evening sessions in each location. Other info in Thursday's Order: Public Comment Hearings are to be held 10/8/2007 - 10/19/2007 in Morgantown, Canaan Valley, Moorefield, and Grafton as can be accommodated; Deadline for propounding discovery in preparation of the 12/5/2007 testimonies is due 11/10/2007; Status Hearing/Charleston Public Comment Hearing set for 11/28 - 11/29/2007; Staff and Intervenors' prepared Direct Testimony due by 12/5/2007; Prepared Rebuttal Testimonies to TrAILCo's direct testimony due by 12/5/2007 We will need to develop questions for "discovery" by Nov. 10, and have our direct testimony prepared, as well as rebuttal to Allegheny's testimony, by Dec. 5. We should also be prepared to respond to requests for Discovery from Allegheny by Nov. 20, as we will have 10 days to respond to their questions. JBK P.S. Because reaching 450 ppm (or possibly less) triggers potentially irreversible glacial melt and sea level rise. Because 53% of Americans live in and around coastal cities and towns and, beginning with just one meter of sea level rise, many of these cities and towns will be inundated. Scientists are forewarning that at approx. 450 ppm CO2 in the atmosphere, we will trigger potentially irreversible glacial melt and sea level rise "out of humanity's control"2. We are currently at 385 ppm, and are increasing atmospheric concentrations of CO2 at approx. 2 ppm annually. At this growth rate, we will reach 450 ppm in *2035*. We are now reaching the peak in global oil and natural gas production. The global static lifetime of conventional oil is approx. 40 years, natural gas 60 years. As oil and gas peak, prices will increase dramatically and alternatives will become more economically attractive. After they peak, oil and gas consumption will decline, being consumed more sparingly, with their depletion rates stretching out over many years. *How?* We call for a moratorium on new conventional coal plants and phase out existing coal plants. This puts an immediate cap on coal plant emissions while allowing enough time to retrain coal workers for healthier jobs. In the US, there are over 600 existing coal plants and 151 new coal plants in various stages of development.3 *How do we meet our expanding electrical energy needs?* We cut consumption. Without an increased demand for electrical energy, there is no need for additional coal-fired power plants. *Can we do it?* Yes. We've done it before. Over an 11-year period (1973–1983), the United States built approx. 30 billion square feet of new buildings, added approx. 35 million new vehicles and increased real GDP by over one trillion dollars (in year 2000 dollars) while decreasing its energy consumption and CO2 emissions. *Where do we start?* Buildings. Buildings use 76% of all the electrical energy produced at coal plants. Buildings are the single largest contributor to global warming, accounting for almost half (48%) of total annual US energy consumption and CO2 emissions. *But we have too many existing buildings.* By the year* 2035* (the same year the planet is projected to reach 450 ppm), *three-quarters* of the built environment in the US will be either new or renovated. This transformation of the built environment over the next 30 years provides a historic opportunity to dramatically reduce the Building Sector's CO2 emissions. *What's the plan?* By implementing The 2030 Challenge to reduce building energy use of new and renovated buildings by a minimum of 50%, we negate the need for new coal plants. Renovating existing buildings to consume 50% less fossil fuel energy allows for new buildings that meet the 50% reduction to be built without increasing the Building Sector's energy demand. Then, by reducing building energy use of new buildings an additional 10% every five years to achieve carbon neutral by 2030, and by using renewable energy, we ultimately negate the need for existing coal plants. The 2030 Challenge, a global initiative, has been adopted and supported by the US Conference of Mayors, American Institute of Architects, US Green Building Council, International Council for Local Environmental Initiatives, National Association of Counties, EPA's Target Finder and numerous states, counties and cities. *Doesn't this require new technology?* No. >From 1973 to 1983, we were able to decrease energy consumption and emissions by using increased efficiency and cost-effective, readily available, off-the-shelf materials, equipment and technology. We have what we need. The 2030 Challenge targets can be accomplished by using innovative sustainable design strategies, generating on-site renewable power and/or purchasing (20% max.) renewable energy. *Why can't we just reduce our Energy Intensity by 1% a year, like many are advocating?* The US has reduced its Energy Intensity (energy consumption per GDP) by 1.5%on average every year since 1980 while increasing its CO2 emissions by approx. 40%. Those calling for a 1% reduction are advocating for less than we have done for the last 27 years, understanding that even a 1.5% reduction has had no effect on CO2 emissions. *What about China?* The US, Japan and the European Union consume 78% of all Chinese exports, fueling China's economic growth. If we collectively call for a global moratorium on new coal-fired power plants and show how it can be done, China will follow to ensure its continued growth. We must get our own house in order before we expect others to, then we can call for a global moratorium. *We can** **Stop Global Warming.* If we stop building coal-fired power plants, phase out existing coal plants and simultaneously reduce the energy consumption and emissions of the Building Sector, we can avert the worst consequences of climate change. If we begin now, we make it; the numbers are on our side. If we wait, even a few years, this window of opportunity is lost. *What can I do, the coal lobby is too powerful?* Make your voice heard. Polls show that the American people are very concerned about global warming. What's lacking is the political will to do what needs to be done. If enough Americans make clear that they are not willing to gamble our nation's future, our children's future, those who wish to lead will find the political will to do the right thing. Directions: >From Charleston: Take Interstate 64 west to Hurricane exit. Get off and turn right into Hurricane to first light. Take a right and go one short block to the next light. Take another right and go one street up to Virginia Ave. Take a left onto this street and go about 2 miles due west to a small corporation called "GBC"-Greif Brothers. When you reach this spot there will be a road on your right called Benedict Rd. Take this right and go for 4 miles up the ridge road (it will seem like more!) until you see the lights and signs! From: Huntington: Take Interstate 64 east to the Milton exit. Get off and turn right into Milton. Go to Hwy. 60 and take a left going East for about 4 miles to the little town of Culloden. You will see an Exxon station on your left. Turn behind this station and go up two blocks to Benedict Rd. Take a left and go 4 miles north up the ridge road till you see the lights and signs! Bring anything to camp out and any items for the Auction.
