The bill caps 80 percent of total U.S. emissions. It sets out a goal of reducing capped emissions 15 percent by 2020 and 70 percent by 2050. Taking additional energy efficiency provisions into account, the bill would result in a 51-63 percent reduction in total emissions. The bill would initially auction only 24 percent of its allowances, rising to a 73 percent auction in 2036. Statement of Carl Pope, Sierra Club Executive Director "We very much appreciate the leadership Senators Lieberman and Warner have shown by taking on this extremely important issue. We also compliment them for having made some positive adjustments to their legislation since it was first proposed. We applaud Senator Boxer for taking up this issue in her committee at such a critical moment. "The bill is a significant political step forward for the U.S. Congress, but unfortunately the legislation as introduced still falls short what is demanded by the science and the public to meet the challenge of global warming. This comes even as U.S. states, cities, and counties move forward with ambitious, science-based proposals to tackle the issue. We look forward to working with Senators to seek the additional improvements necessary for the bill to sufficiently address the challenge before us. "At this crucial moment, we must continue to insist on a global warming bill that is committed to scientific integrity and economic fairness. In order to prevent the most catastrophic effects of global warming, we must cut emissions 80 percent by 2050--an achievable annual reduction of about 2 percent. In order to get the market moving and bring America's clean energy future to life, any bill must start out strong by seeking a short-term reduction on the order of 20 percent of total emissions by 2020. Disturbances to the climate have come more quickly and forcefully than even the most pessimistic among us predicted. The Lieberman-Warner bill, as introduced, leaves us in serious danger of reaching the tipping points that scientists tell us could lead to catastrophic changes to the climate. "Polluters should pay for what they do and any bill must allocate allowances for the public benefit, not private windfalls. A 100 percent auction would not only ensure that polluters pay for the damage they are doing to the climate, but would also provide the funds necessary to ensure a just transition for workers, protect consumers from rising energy costs, and make the investments in new technology needed to make the new clean energy economy a reality. While the bill has moved in the right direction, it gives too many free allowances to polluters for far too long--enriching executives and shareholders instead of generating the funds needed to help us meet our emissions goals and ensure a smooth transition to the clean energy economy. "We also urge the Senate to continue to press ahead toward passage of a final energy bill. Sierra Club Wins One in Iowa

Coal-Fired Power Plant Blocked in Iowa DES MOINES, Iowa, October 15, 2007 (ENS) - Opponents of a new coal-fired power plant proposed in Waterloo, including the Sierra Club and the Iowa Farmers Union, celebrated a victory Thursday when a state panel rejected the City of Waterloo's request to annex land for the plant. The City Development Board decided that the annexation of land owned by residents who oppose the annexation did not meet the state guidelines for approval. Hundreds of citizens protested the annexation at a hearing in September. LS Power is proposing the $1.5 billion, 750-megawatt plant to serve up to 500,000 homes, some of which may be out of the state. "It was clear that this annexation was not in the public interest," said Carole Yates of the Cedar Prairie Group of the Sierra Club. "Coal-fired power plants are the largest source of global warming in the country and this proposal was a collection of worst practices - for our energy system, for our economy, for the environment, and for our community." The annexation proposal came before the City Development Board because a landowner, retired farmer Merle Bell, is standing against the plant. Last month more than 500 people rallied at Bell's farm in support of Bell and against LS Power. His farm has been in his family for more than a century. "I've lived on this land all my life," says Bell. "I promised my father I'd never sell the farm and I don't want to sell." Bell was joined in opposing the annexation and development of the site by neighbor Phyllis Morgan and 17 farmers who are opposed to plans for transmission lines across their land. The farmers' resistance attracted the attention of Iowa Farmers Union, which officially opposes the plant. "We have concluded that farmers benefit more from farm-based renewable energy than from giant new coal plants. We consider plants like this a threat to a sustainable, farm-based rural economy," said Gregg Heide of Pomeroy, board member of Iowa Farmers Union. Sierra Club and the citizen advocacy group, Community Energy Solutions, represented by nonprofit law firm Plains Justice, filed briefs against the proposal. "This is the beginning of the end for LS Power in Iowa," said Sierra Club organizer Mark Kresowik. "States across the country are recognizing the dangers of overdependence on coal and have rejected new plants. It's time for Governor Culver to truly embrace energy efficiency and renewable energy and say no to more dirty coal." The lack of annexation approval may not mean the end for this project as the city can reapply with a different configuration of land to be annexed. LS Power Project Manager Mark Milburn said the vote does not derail the project, which could go on even without annexation. But the utility wants to pay taxes to the city, and it makes sense to add the land to the already developed nearby industrial park, he said. Florida, Oklahoma, Delaware, Idaho, and California have rejected new coal plants in favor of cleaner energy options in the past 12 months.

PSC hearings phone bank

Some of the students have tentatively agreed to help out with phone banking to our members next Wednesday, Oct. 17 from 6-8 PM. We need to get a list of members in Monongalia, Preston, Marion, Taylor, Tucker, Grant, Hardy, and Hampshire Counties, as well as their phone numbers (specifically avoid those who have asked not to be called. I will prepare a simple script along the lines of: "Hi, I am ___ and I am calling on behalf of Sierra Club. We want you to come to a public hearing to speak against the proposed Allegheny line. The hearings are ..... Dates, times, locations, etc.... Can we count on you to join us? Would you be able to bring friends?, etc. etc. Is that date OK? Does anyone have a suggestion on where to do this? Any other volunteers? (I said I would bring a pizza). The first hearing is the following week, Oct. 23 in Morgantown, so we need to get started. There were two columns in the Gazette this week that CTL is the wrong way to go, but apparently Rockefeller has not gotten the message. The requirement for carbon capture may make this moot, but it is still a dangerous precedent. See story below from Huntington News Net. JBK ***** Oct. 6, 2007 Finance Committee Endorses Rockefeller Coal-to-Liquid Development Proposal By HNN Staff >From Senator Rockefeller's Office Washington, DC (HNN) – Late last night, Senator Jay Rockefeller (D-WV) brokered an agreement with members of the Senate Finance Committee to keep the development of coal-to-liquids (CTL) technology advancing in the right direction. “Many of us have come to understand that a responsible energy policy requires us to harness all of our abundant natural resources, including coal, and to demand and help spawn clean technologies. Clean coal-to-liquids conversion can and should play a big part in achieving energy independence that is so critical to our national security,” Rockefeller said. Specifically, Rockefeller worked with his colleagues to extend the alternative fuel tax credit for CTL development for three more years. To qualify, developers will need to demonstrate that they can capture 50 percent of the carbon emissions from a CTL facility over the next two years; then 75 percent by 2010. The agreement was reached as part of the Finance Committee’s deliberations on a major agricultural assistance bill that included tax incentives aimed at spurring rural development. The bill also includes tax incentives aimed at other alternative fuel research, such as ethanol and other biofuels, natural gas and wind power. “There is no single alternative fuel source that will address our growing energy needs and lessen our dependence on foreign sources of energy. We need to be investing in every solution and hold every solution to a high “green technology” standard. The responsible use of clean coal to meet our electricity and transportation needs must be in the mix,” Rockefeller said. “By including coal-to-liquids in this bill, we’re sending a signal to Wall Street and investors that coal conversion is a technology worth investing in.” Senator Rockefeller has long-supported efforts that would promote CTL development and believes CTL can and must meet high environmental standards. As part of the Senate debate on the Energy Act of 2007, Senator Rockefeller supported efforts to begin a substantial federal government investment – along the lines of the Apollo space program – to begin researching and developing a workable carbon capture and sequestration solution. Additionally, he’s working on legislation that would create a Future Fuels Corporation – a large scale joint government and private effort to finally solve carbon capture. Rockefeller noted that the ability to capture industrial carbon emissions will be the challenge of the coming decades and is crucial to addressing the problem of global climate change. Rockefeller also promoted CTL development in legislation he authored earlier this year to reauthorize the Federal Aviation Administration. The Senator is advocating for the creation of a national center of excellence to develop coal-to-jet fuel technologies. PSC Public hearings

As of 5 PM Tuesday, no additional info on public hearings has been filed on the PSC web page. The order from last Thursday calls for FOUR hearings to be held between Oct. 8 and Oct. 19 "or as soon thereafter as can be accommodated". The hearings will be held before an Administrative Law Judge, not the Commissioners. Hearings will be held both during the day and in the evening to accommodate those who wish to attend. This makes it easier for some people, but it means getting people to both the day and the evening sessions in each location. Other info in Thursday's Order: Public Comment Hearings are to be held 10/8/2007 - 10/19/2007 in Morgantown, Canaan Valley, Moorefield, and Grafton as can be accommodated; Deadline for propounding discovery in preparation of the 12/5/2007 testimonies is due 11/10/2007; Status Hearing/Charleston Public Comment Hearing set for 11/28 - 11/29/2007; Staff and Intervenors' prepared Direct Testimony due by 12/5/2007; Prepared Rebuttal Testimonies to TrAILCo's direct testimony due by 12/5/2007 We will need to develop questions for "discovery" by Nov. 10, and have our direct testimony prepared, as well as rebuttal to Allegheny's testimony, by Dec. 5. Stop Coal." http://www.architecture2030.org/current_situation/stop_coal.html *Want to stop global warming? *Stop Coal. *Why?* Because coal is the only fossil fuel plentiful and supposedly cheap1 enough to push the planet to 450 parts per million (ppm) of carbon dioxide (CO2) in the atmosphere. Because reaching 450 ppm (or possibly less) triggers potentially irreversible glacial melt and sea level rise. Because 53% of Americans live in and around coastal cities and towns and, beginning with just one meter of sea level rise, many of these cities and towns will be inundated. Scientists are forewarning that at approx. 450 ppm CO2 in the atmosphere, we will trigger potentially irreversible glacial melt and sea level rise "out of humanity's control"2. We are currently at 385 ppm, and are increasing atmospheric concentrations of CO2 at approx. 2 ppm annually. At this growth rate, we will reach 450 ppm in *2035*. We are now reaching the peak in global oil and natural gas production. The global static lifetime of conventional oil is approx. 40 years, natural gas 60 years. As oil and gas peak, prices will increase dramatically and alternatives will become more economically attractive. After they peak, oil and gas consumption will decline, being consumed more sparingly, with their depletion rates stretching out over many years. *How?* We call for a moratorium on new conventional coal plants and phase out existing coal plants. This puts an immediate cap on coal plant emissions while allowing enough time to retrain coal workers for healthier jobs. In the US, there are over 600 existing coal plants and 151 new coal plants in various stages of development.3 *How do we meet our expanding electrical energy needs?* We cut consumption. Without an increased demand for electrical energy, there is no need for additional coal-fired power plants. *Can we do it?* Yes. We've done it before. Over an 11-year period (1973–1983), the United States built approx. 30 billion square feet of new buildings, added approx. 35 million new vehicles and increased real GDP by over one trillion dollars (in year 2000 dollars) while decreasing its energy consumption and CO2 emissions. *Where do we start?* Buildings. Buildings use 76% of all the electrical energy produced at coal plants. Buildings are the single largest contributor to global warming, accounting for almost half (48%) of total annual US energy consumption and CO2 emissions. *But we have too many existing buildings.* By the year* 2035* (the same year the planet is projected to reach 450 ppm), *three-quarters* of the built environment in the US will be either new or renovated. This transformation of the built environment over the next 30 years provides a historic opportunity to dramatically reduce the Building Sector's CO2 emissions. *What's the plan?* By implementing The 2030 Challenge to reduce building energy use of new and renovated buildings by a minimum of 50%, we negate the need for new coal plants. Renovating existing buildings to consume 50% less fossil fuel energy allows for new buildings that meet the 50% reduction to be built without increasing the Building Sector's energy demand. Then, by reducing building energy use of new buildings an additional 10% every five years to achieve carbon neutral by 2030, and by using renewable energy, we ultimately negate the need for existing coal plants. The 2030 Challenge, a global initiative, has been adopted and supported by the US Conference of Mayors, American Institute of Architects, US Green Building Council, International Council for Local Environmental Initiatives, National Association of Counties, EPA's Target Finder and numerous states, counties and cities. *Doesn't this require new technology?* No. >From 1973 to 1983, we were able to decrease energy consumption and emissions by using increased efficiency and cost-effective, readily available, off-the-shelf materials, equipment and technology. We have what we need. The 2030 Challenge targets can be accomplished by using innovative sustainable design strategies, generating on-site renewable power and/or purchasing (20% max.) renewable energy. *Why can't we just reduce our Energy Intensity by 1% a year, like many are advocating?* The US has reduced its Energy Intensity (energy consumption per GDP) by 1.5%on average every year since 1980 while increasing its CO2 emissions by approx. 40%. Those calling for a 1% reduction are advocating for less than we have done for the last 27 years, understanding that even a 1.5% reduction has had no effect on CO2 emissions. *What about China?* The US, Japan and the European Union consume 78% of all Chinese exports, fueling China's economic growth. If we collectively call for a global moratorium on new coal-fired power plants and show how it can be done, China will follow to ensure its continued growth. We must get our own house in order before we expect others to, then we can call for a global moratorium. *We can** **Stop Global Warming.* If we stop building coal-fired power plants, phase out existing coal plants and simultaneously reduce the energy consumption and emissions of the Building Sector, we can avert the worst consequences of climate change. If we begin now, we make it; the numbers are on our side. If we wait, even a few years, this window of opportunity is lost. *What can I do, the coal lobby is too powerful?* Make your voice heard. Polls show that the American people are very concerned about global warming. What's lacking is the political will to do what needs to be done. If enough Americans make clear that they are not willing to gamble our nation's future, our children's future, those who wish to lead will find the political will to do the right thing. They will do what it takes to secure our future, calling for a moratorium on coal and embracing not only The 2030 Challenge, but all the many other worthwhile initiatives that can help undo the damage caused by CO2. Word-of-mouth and the Internet are the most powerful and effective forms of communication today. Contact your federal, state and local representatives. Demand a MORATORIUM ON COAL. Dear Committee, The energy committee recently had a meeting regarding the Allegheny intervention case. While there are many stages that can be considered "next," one stage that needs leadership is the education campaign. This work has come to the foreground because soon the PSC will be announcing the dates for public hearings. We, of course, want to see as many Sierran members at these county meetings as possible. An education campaign will entail a bulk mailing of bulleted information to Sierra Club members. As we all know, citizens do not have to be living along the power line to have a voice against it. The mailing will also include the dates for the hearings. Is someone willing to take this responsibility on? I and others will assist, of course. Thanks Caryn Staff Seeks Delay in Hearing on Proposed Power Line By Sandhya Somashekhar Washington Post Staff Writer Friday, September 21, 2007; Page B06 Virginia utility regulators have asked for more time to study whether Dominion Virginia Power should be allowed to build a high-voltage power line through a 65-mile stretch of rural Northern Virginia. The staff of the State Corporation Commission has asked the commission, which approves power lines, to postpone arguments scheduled for Jan. 14 Dominion's application is "voluminous" and "both complex and novel," according to a four-page staff request released Wednesday. The staff asked that the Richmond hearing be delayed until Feb. 25. In addition, staff members said they want additional time to consider whether a high-voltage line proposed for Maryland would affect whether the Virginia power line is needed. Dominion, which contends that the Virginia line is needed to guard against blackouts, is reviewing the commission staff request, a spokeswoman said. If the commission delays the project for more than a year, the company might be allowed to bypass the state and appeal directly to the federal government under a new federal law. The Piedmont Environmental Council, a nonprofit organization that is leading opposition to the line, said it is pleased with the staff's request. They recognize it's not as simple as the scare tactics of, 'Your lights are going to go out if you don't get this line,' " council spokesman Robert W. Lazaro Jr. said. "It is very significant." The 270-mile, 500-kilovolt transmission line, a joint project of Dominion and Pennsylvania-based Allegheny Power, would carry electricity from coal-fired plants in the Midwest to fast-growing Northern Virginia. Dominion would be in charge of the eastern part of the line, which would begin in Frederick, Va., and end in Loudoun County, slicing through parts of Fauquier, Rappahannock, Culpeper, Warren and Prince William counties. The estimated cost of that portion of the line is $243 million The other project the commission staff wants to study is a $1.8 billion, 300-mile high-voltage line proposed by Allegheny and American Electric Power. It would start in West Virginia and end in Frederick County, close to the Montgomery County border. Both proposals have provoked an outcry from preservationists and landowners, who worry that the cables and lofty steel towers will mar the landscape and bring down property values. In addition, the environmental council has argued that Virginia does not need the Dominion line. On Monday, the organization published a report that says Dominion and Allegheny misrepresented the data to prop up the case for the line and that they ignored "less costly and less environmentally damaging solutions." In April, Dominion released a report that warned of "significant problems in the system that will require new transmission facilities by 2011." This week, the utility company announced energy conservation initiatives to help meet the growing demand for electricity in Virginia. A hearing examiner for the State Corporation Commission is to decide this fall whether to delay arguments in the case. We would need a celebrity to make a speech, or do a concert........ The Commissioners of the PSC are not going to be standing on the steps at the Capitol, waiving cheers to the crowd. TrAILCo has already responded to discovery from the Staff and the WVEUG and expect thats TrAILCo, rather than the other parties, will be the principal server of discovery in the week ending December 7, 2007 Obviously, there is a premium on getting discovery out first. In that regard, however, we need to know what, if any, additional information any expert we retain may need. The expert's testimony will need to be filed by December 5. The status hearing set for November 1 is intended, in part, to deal with any pending discovery disputes, again reinforcing the idea of propounding discovery earlier rather than later. The other project to watch is the joint AE-AEP 765-kv line (PATH) from the John Amos plant near Charleston to somewhere in New Jersey. If TrAIL is approved, I suspect that PATH will be next. Furthermore, if the NIETC is approved, Jefferson County could easily be in the route for this or other lines. Hence, stopping TrAIL is important, even if this particular line is not in your back yard. Jeff I presume that you get the Governor of Pennsylvania's regular newsletter. It is interesting to note that as a coal mining State, his emphasis is on jobs from renewable energy...and no mention of CTL. He claims to have developed 1500 jobs already and anticipates 35,000 jobs in renewable energy industries. And his emphasis is on Energy Independence. There is also a bit of a sleeper out there in the shale oil of Utah, Colorado and other sites. There are those stating that the real stealth energy strategy of the US Government, as expressed in the current energy bill before Congress and the one passed in 2005, is empowering companies to begin serious drilling to extract oil from these Western oil shale deposits. The sites are almost all public lands. The estimates are that the reserves there are the largest deposits of crude in the world...and while there has been a hold placed upon these deposits since the late 30's, they are now being developed rather quietly by the Bush Administration as a hedge against energy security threats. The current estimates is that the oil there can be recovered for anywhere from $25 to $45 per barrel. I am sure that you would agree that we must take this into consideration as we develop our energy plan. Already, some Pennsylvanians have suffered the sticker shock caused by the expiration of caps on electricity rates. Over the next three years more Pennsylvanians will see their rates increase as these caps expire. My strategy can soften the impact of the cap expiration by investing $850 million in solar and wind energy production as well as in conservation improvements in the electricity distribution systems. My proposal rewards consumers who purchase energy-efficient appliances and those who decrease energy usage in their homes. My Energy Independence Fund will attract new companies to Pennsylvania and help grow those already here in the alternative energy sector in our state. And, it will mean our consumers save money on their electricity bills. I believe it is urgent that the members of the General Assembly debate and pass a sound energy package that: (1) increases our national security by addressing our reliance on foreign oil; (2) invests funds to ensure Pennsylvania has the best alternative energy and conservation companies; and (3) rewards consumers who conserve energy. The Times WV reported yesterday that an alternate route has been proposed: The alternate path, called the Grafton Area Route, follows the proposed route to the southern part of Monongalia County and parallels the existing transline that goes to a substation in Pruntytown, he said. It runs through Marion, Taylor and Preston counties and then continues on the proposed route. "I'm against that power line and the destruction of so much of our pristine countryside," Marion County Commissioner Randy Elliot said. "The new plan needs to go into (review) to have less of a negative impact. Lupardo, D-Endwell, and others by an energy company that wants to develop a power line through upstate New York. New York Regional Interconnect filed suit earlier this year against Lupardo as the author of a new state law that prevents energy companies such as NYRI from using eminent domain to seize private property. The lawsuit also names state Sen. John Bonacic, R-Mt. Hope, who sponsored the legislation in the state Senate. State lawmakers have fought NYRI by enacting legislation. Lupado cited the potential environmental and economic damage the project would do to the upstate counties through which the proposed power line would be constructed. The project would supply power only to the New York City area. NYRI is claiming it has been harmed by the state law sponsored by Lupardo and Bonacic. Cuomo is expected to argue that NYRI has not been harmed because its application is still pending before a federal agency. Also named in the NYRI lawsuit is Gov. Eliot Spitzer, former Gov. George E. Pataki, several state officials, and other upstate elected officials including state Sen. Thomas W. Libous, R-Binghamton. Lupardo said a court hearing on the matter has been scheduled for Nov. 11 in Albany's federal court before Senior U.S. District Court Judge Thomas J. McAvoy. Sens. Charles E. Schumer and Hillary Rodham Clinton, both D-NY, are also seeking to restrict the exercise of eminent domain by energy companies, Lupardo said. Earlier this month, a similar amendment sponsored by Rep. Michael Arcuri, D-Utica, and Rep. Maurice D. Hinchey, D-Hurley, died in the House of Representatives.

We support the addition of 35 days to the original proposed schedule, to provide that the Evidentiary Hearings in Charleston take place after the holiday months of November and December of 2008, the new dates becoming January 9th thru January 18th. 2. We take exception to the proposal that Reply Briefs be due on February 26, 2008, just 11 days after the due date of February 15th for the Initial Briefs. We believe that an additional 6 days is appropriate for the due date of the Reply Briefs, as this is an extremely complex and extensive case, and because for the most part the intervenors are relying upon volunteer or part-time assistance in their legal preparations. NIETC issues.

To: Energy Committee. It occurs to me that the NIETC components of the US Energy Policy Act of 2005 may be unconstitutional given that this act provides powers to the federal government that are in the domain of "state's rights". Consider that the federal government has apparently backed off of requiring the State of Nevada to accept the long-term storage of radioactive wastes from the nuclear power plants. Does anyone know whether the Sierra Club or others are intending to challenge this part or other parts of the Energy Policy Act of 2005? p.s. Now that Allegheny Energy is intending to use federal authority to charge back costs for planning the TrAIL line, we have a much larger set of issues to face, and more outrage on the part of the general public. ************************************** See what's new at http://www.aol.com

Testimony on Reliability

To: Energy Committee. I met with Ron Klein, retired WVU professor of electrical engineering, this past Friday afternoon. We discussed the preparation of testimony regarding the proposed TrAIL line. We decided to focus on the areas of reliability and congestion. We had an extensive discussion. I printed off some documents from the PSC web pages for him and gave him some example materials from the Longview case. We are both currently reading and preparing for a working session this coming week. It is important for us to do a substantial amount of study to feel comfortable about the case, so as to permit the preparation of an outline or draft of possible expert testimony. This is the current priority. My approach is to get his participation at little or no cost. I'll get a better reading on this during the coming week. So, Jonothan and I can hopefully meet with him a couple of times this coming week. Duane p.s. I came home from Pennsylvania with a few additional ideas about testimony for the TrAIL case and am working to put a summary together. Quarter-Degree Fix Fuels Climate Fight By ANDREW C. REVKIN, The New York Times Posted: 2007-08-26 13:51:58 Filed Under: _Science News_ (http://news.aol.com/science) (Aug. 26) - Never underestimate the power of the blogosphere and a quarter of a degree to inflame the fight over _global warming_ (javascript:;) . A quarter-degree Fahrenheit is roughly the downward adjustment _NASA_ (javascript:;) scientists made earlier this month in their annual estimates of the average temperature in the contiguous 48 states since 2000. They corrected the numbers after an error in meshing two sets of temperature data was discovered by Stephen McIntyre, a blogger and retired business executive in Toronto. Smaller adjustments were made to some readings for some preceding years. All of this would most likely have passed unremarkably if Mr. McIntyre had not blogged that the adjustments changed the rankings of warmest years for the contiguous states since 1895, when record-keeping began. Suddenly, 1934 appeared to vault ahead of 1998 as the warmest year on record (by a statistically meaningless 0.036 degrees Fahrenheit). In NASA's most recent data set, 1934 had followed 1998 by a statistically meaningless 0.018 degrees. Conservative bloggers, columnists and radio hosts pounced. "We have proof of man-made global warming," Rush Limbaugh told his radio audience. "The man-made global warming is inside NASA." Mr. McIntyre, who has spent years seeking flaws in studies pointing to human-driven climate change, traded broadsides on the Web with James E. Hansen, the NASA team's leader. Dr. Hansen said he would not "joust with court jesters" and Mr. McIntyre posited that Dr. Hansen might have a "Jor-El complex" -- a reference to _Superman_ (javascript:;) 's father, who foresaw the destruction of his planet and sent his son packing. Blogs are still reverberating, but Mr. McIntyre, Dr. Hansen and others familiar with the initial data revisions are clarifying what is, and is not, at issue. One thing not in question, Mr. McIntyre and Dr. Hansen agree, is the merit of shifting away from energy choices that contribute heat-trapping greenhouse gases to the atmosphere. Mr. McIntyre said he feels "climate change is a serious issue." His personal preference is to shift increasingly to nuclear power and away from coal and oil, the main source of heat-trapping carbon dioxide. Mr. McIntyre and Dr. Hansen also agree that the NASA data glitch had no effect on the global temperature trend, nudging it by an insignificant thousandth of a degree. Everyone appears also to agree that too much attention is paid to records, particularly given that the difference between 1934, 1998, and several other sets of years in the top 10 warmest list for the United States are so small as to be statistically meaningless. Mr. McIntyre said that when he posted the revised list under the heading "A New Leaderboard at the U.S. Open," "I just was sort of having some fun with it as much as anything." He added: "The significance of things has been misstated by Limbaugh and people like that." Dr. Hansen and his team note that they rarely, if ever, discuss individual years, particularly regional findings like those for the United States (the lower 48 are only 2 percent of the planet’s surface). "In general I think that we want to avoid going into more and more detail about ranking of individual years," he said in an e-mail message. "As far as I remember, we have always discouraged that as being somewhat nonsensical." Jay Lawrimore, a scientist at the National Climatic Data Center of the Commerce Department who works on assembling the climate records that NASA analyzed, said his agency could probably do a better job of emphasizing the uncertainty surrounding its annual temperature announcements. Indeed, there is enough wiggle room in the numbers that the center has a different list of the 10 warmest years than those produced using NASA’s and Mr. McIntyre’s analyses. By the climate center’s reckoning, 1998 remains the warmest year for the 48 states (with 2006 second and 1934 third). Dr. Lawrimore, Dr. Hansen and other experts said that trends are far more important than particular years, and the recent widespread warming trend has been clear — and very distinct from the regional hot spell that drove up United States temperatures in the 1930s. Mr. McIntyre and the government scientists do agree on at least one more thing: the need to improve the quality of climate data gathered around the world, including in the United States, which has by far the planet’s biggest network of meteorological stations. Mr. McIntyre is not alone in pointing out that the need to adjust and revise such data -- with the attendant risk of mistakes -- would be reduced with more care and consistency taken in collecting climate data. The National Academy of Sciences has repeatedly called for improvements in climate monitoring. An independent group of meteorologists and weather buffs is compiling its own gallery of American weather stations at www.surfacestations.org, with photographs showing glaring problems, like thermometers placed next to asphalt runways and parking lots. Dr. Lawrimore said that the government is preparing to build a climate reference network of more sophisticated, and consistent, monitoring stations that should cut uncertainty in gauging future trends. In any case, he said, the evidence for human-driven warming remains robust. "Saying what they're saying has just provided an opportunity for them to create doubt in people's minds," he said of the bloggers. Although organized opposition to the project has been fierce and many speakers condemned it, a parade of business owners and representatives from Northern Virginia chambers of commerce endorsed it, saying the area's economy will depend on a reliable flow of electricity. This month, Dominion has stepped up its efforts to convince residents that the line is essential for the health of Northern Virginia's electrical grid and that no alternative will suffice. For two days and more than 10 hours, they attacked Dominion Virginia Power's proposed transmission line through the Piedmont. In speeches long and short, impassioned and measured, opponents from Fauquier, Rappahannock, Culpeper, Loudoun and elsewhere hammered away at familiar themes. The utility has failed to demonstrate a need for the planned 500,000-volt line, they told the State Corporation Commission during a public hearing last Thursday and Friday in the Fauquier High School auditorium. The proposed line would destroy vistas and pristine land under easement, diminish property values, degrade air quality and compromise agricultural operations, tourism and historic sites, critics told SCC Hearing Examiner Alexander F. Skirpan Jr.. Ninety-four of the 106 speakers asked Skirpan to recommend denial of the proposed line. Fifty-eight of the public hearing speakers live in Fauquier. (Skirpan will make a recommendation to the SCC's three-judge panel, which will decide the matter.) Just 12 people, representing Northern Virginia businesses or organizations such as the Fairfax County Chamber of Commerce, the Prince William Regional Chamber of Commerce and the Vienna-Tysons Regional Chamber of Commerce, testified in favor of the proposed line. Dominion insists the line must be in place by 2011, or Northern Virginia faces the prospect of rolling blackouts. Its 1,000-page application to the SCC includes a 70-page analysis by Massachusetts-based KEMA Inc. that argues a transmission line would provide the only practical solution to meet Northern Virginia's immediate and long-term electricity demands. The proposed line would link substations in Frederick and Loudoun counties. It would parallel an existing transmission line but require Dominion and its partner, Allegheny Power, to acquire substantial additional rights of way from private landowners. Besides Frederick and Loudoun, the proposed 65-mile line would cut through parts of Fauquier, Rappahannock, Culpeper and Prince William counties. The alternative route would connect the same substations along Interstate 66, using Virginia Department of Transportation right-of-way. Under either scenario, the line would be suspended from steel towers that, in places, could exceed 150 feet. Dominion's "credibility" should be tested, said Kathleen King, a retired federal government lawyer from Broad Run. She claims the utility has given no specifics about the precise location of the proposed power line. "There are absolutely no straight answers," she told the hearing examiner. "I have no idea how close I am to those (proposed) power towers (along I-66), but I'm close....We can't get information from the applicant to tell us where the power line is going." Like many others, King believes that conservation methods and more efficient technology would eliminate the need for a new line. Her remarks elicited cheers and clapping, which Skirpan quickly squelched with a stern reminder. Before the hearing started Thursday afternoon, he explained to the audience that the hearing would be operated similar to a courtroom proceeding. Speakers, which he called witnesses, would be sworn in and could be subject to questioning by SCC staff and lawyers and attorneys representing various interests. "It's not a situation where we have audience participation," Skirpan said. "I don't want applause, boos or any types of comments from the audience." If necessary, he would evacuate the auditorium and listen to speakers individually. William Arrington of Catlett called the proposal "ill-conceived." Arrington contended that Dominion has yet to demonstrate a need for the line, which he claims would violate the sanctity of conservation easements. He also said the line would produce electromagnetic fields, posing "unacceptable health risks to the general public." If Northern Virginia indeed needs substantially more electricity, then build a power plant there, Arrington suggested. William Stribling of Markham said the I-66 alternative would devastate an area rich with historic and agricultural importance, undermining Fauquier's agribusiness and tourism economies. Harry Atherton, who represents Marshall District on the Fauquier County Board of Supervisors, spoke as a private citizen. He pointed out that Fauquier has one of the highest concentrations of conservation easements in the nation, with more than 77,000 acres permanently protected from further development. Moreover, he said it claims 29 sites on the Virginia Landmarks list and National Register of Historic Places, two scenic rivers, 10 Civil War battlefields, 17,000 acres in historic districts, 8,000 acres in state management reserves, 1,800 acres of state park land and 1,000 acres of county park land. "This is not by accident, but the result of many decades of public and private efforts to preserve this historic and beautiful part of [Virginia]" he concluded. "If the end result of these efforts is that the county has become the corridor of least resistance for the transmission line of power to the Mid-Atlantic, this seems both unfair and unnecessary." Fauquier's population stands at "just over 60,000" and thus isn't "a significant contributor to congestion on the Northern Virginia [power] grid," Atherton also noted To the contrary, Fauquier has been part of the solution to the area's energy needs, because it approved two natural gas-fueled generators near Remington that operate during the hottest and coldest days, he claimed. Katherine Kristie of Rappahannock County focused on air quality and health-related issues. The proposed line would transmit electricity generated by some of the nation's "dirtiest" coal-burning plants, Kristie said. "Why?" she asked. Because "it is much cheaper for the power industry to continue to rely on some of the dirtiest plants than to utilize cleaner-generation energy plants located closer to northeast customer demand." Kristie continued: "But when public health costs and environmental impacts are considered, is this truly the cheapest solution?" She and other critics also believe Dominion wants the line chiefly because it would reap huge profits from electricity destined for the Northeast. The KEMA report does not address the line's financial implications for Dominion. KEMA's Jeff Palermo, who helped prepare the transmission line study, said Northern Virginia, a "big-time" importer of electricity, would be the primary beneficiary of the line, not the eastern seaboard. Northern Virginia's business community was represented in force at the hearing. Virginia Chamber of Commerce President Hugh Keogh said the continued robust expansion of the region's economy depends the "predictability and availability" of electricity. Northern Virginia generates high-paying technology jobs that provide spinoff financial benefits for the entire state, Keogh said. A perceived lack of energy in the next decade could threaten future economic development opportunities, he added Fairfax County Chamber of Commerce William D. Lecos called Northern Virginia the state's "economic engine." As its high-tech sector grows, so must critical infrastructure such reliable electricity sources to sustain business, Lecos said. "There's every reason to believe this trend [of economic growth] will continue," he said. Representatives of the National Association of Industrial Office Properties and several businesses spoke in support of the power line. SCC hearings will continue during the next two weeks in Prince William County, Winchester and Front Royal. Dominion Spokeswoman Le-Ha Anderson said the hearing offered no surprises. "We feel that, frankly, it was an example of why the SCC process is fair," giving people a chance "to talk as long as they wanted to" about issues that concern them, Anderson said. "It was nice to hear from independent organizations, businesses and associations" that support the line, she added. Despite widespread objections to the proposal, Anderson said "We still believe the need is great. We're steadfast in the belief the need is real." The hearing turnout and "quality of testimony" impressed Chris Miller, president of Piedmont Environment Council, which plans to spend more than $2 million to fight the project. "Are the hearings meaningful?" Miller said. "Yes. You're getting hundreds of people testifying about the [line's] impacts on their lives. The quality of testimony is very high. There's a lot of information that otherwise would not be on the record." Some people waited up to four hours to testify, he said. For one, none of the 32 speakers at James Wood High School on Monday supported the proposed joint project from Dominion Virginia Power and Allegheny Energy’s Trans-Allegheny Interstate Line Co. subsidiary. The hearings in Warrenton at least had a few contractors and developers who appeared to back the project, which power company officials say is needed to provide for increased electricity needs in Northern Virginia. The general theme from the first day of public testimony at James Wood suggested that neither Allegheny nor Dominion had provided information to support the claim that the new lines are needed. No one from either company testified. That testimony will come in evidentiary hearings beginning on Jan. 14 in Richmond. Alexander F. Skirpan Jr., the hearing examiner for the State Corporation Commission, will listen to all of the testimony at each hearing and then file a recommendation with the commission, which will decide the fate of the proposal, said Andy Farmer, the SCC’s education resources manager. Skirpan reminded people attending Monday’s morning and evening hearings that this was a court of record for the testimony and that audience participation, including clapping in favor of some remarks, would not be viewed favorably. He confirmed that position during the morning hearing when the audience applauded testimony from Wingate Mackay-Smith of White Post. She said she was speaking with mixed emotion, but reminded those in attendance that approval of the proposal was similar to giving the 800-pound gorilla a banana. "There’s no evidence that Virginia has any need for new lines to avoid blackouts in 2011, as the companies claim," Smith said, drawing some enthusiastic cheers. Skirpan quickly responded, reminding everyone that he could close the hearings if they continued to interrupt testimony. He encountered no such problems in the evening session. Clarke County Board of Supervisors Chairman John Staelin, the lone local officeholder to speak on Monday, said his board had opposed the possibility of a high-voltage line through his county a year ago, leading to a unanimous resolution in opposition. "I came here today because I want to make sure you know this is not a ‘Not in my backyard’ issue," he said. "This power line may have moved out of Clarke County’s backyard, but that does not suddenly make it a better idea for either Clarke or the rest of the citizens of the commonwealth." Elizabeth Tate of Star Tannery offered a theme that was echoed by many, noting that Allegheny’s treatment of the landscape had decreased the values of property. She said her family had tried to leave behind the visual clutter in Virginia Beach for the unscarred environment of the northern Shenandoah Valley, but added that the proposal would put a gash in the trees and bring other unsightly problems. Eleanore Boudreaux of Stephens City agreed, noting that she had lost livestock and value to her property because of moves by Allegheny. Ellen Rivers of Frederick County said Virginia has to set a good example, evaluating the effects of the lines before approving them. Barbara Smith of Stephens City said another potential concern for the lines would be their impact on tourism, particularly the effect on sightlines near the Cedar Creek Battlefield and Belle Grove Plantation near Middletown. Stanley M. Hirschberg, president of The Cedar Creek Battlefield Foundation, agreed, noting that tourist dollars may disappear along with the views if 120-foot-tall power lines are installed. The hearings at James Wood will continue today at 9:30 a.m. Additional public hearings are scheduled at the North Warren Volunteer Fire Department near Front Royal on Wednesday and Thursday. For years, the agency has ignored the law and allowed thousands of miles of headwater and perennial streams in Appalachia to be permanently buried by coal companies under millions of tons of waste generated by mountaintop removal coal mining. Known as the "stream buffer zone rule," this decades-old regulation has prohibited surface coal-mining activities from disturbing areas within 100 feet of streams. A copy of the proposed changes to the buffer zone rule is available at: http://www.earthjustice.org/library/legal_docs/draft-environmental-impact-s… "The Bush administration just doesn't give up in its quest to give away more and more legal protections to the mountaintop removal polluters," said Joan Mulhern, Senior Legislative Counsel for Earthjustice. "Despite the federal government's own studies showing widespread, harmful, and irreversible stream loss in the region, the OSM proposes exempting the most harmful mountaintop removal mining activities from the buffer zone rule. Once again, OSM is demonstrating that it is not an effective regulator for the public, but the 'Office for Slicing Mountains' and 'Office of Stream Mangling' for coal companies." The new exemption is the latest chapter in a long-running effort by the Bush administration to allow coal companies to avoid compliance with both the Surface Mining Control and Reclamation Act (administered by OSM) and the Clean Water Act. According to OSM's own figures, 1,208 miles of streams in Appalachia were destroyed from 1992 to 2002, and regulators approved 1,603 more valley fills between 2001 and 2005 that will destroy 535 more miles of streams. Those actions were taken in defiance of the plain language of the existing rule. Under the plan announced this week, OSM proposes to change the rule to conform with its deviant behavior. It would exempt from the stream buffer zone rule those very mountaintop removal activities that are most destructive to streams, including "permanent excess spoil fills, and coal waste disposal facilities" – in other words, giant valley fills and sludge-filled lagoons. "OSM has chosen to turn its back onirreplaceable water resources of the Appalachian region," said Cindy Rank with West Virginia Highlands Conservancy."Headwater streams are the lifeblood of the mountains and those of us privileged enough to livein those mountains.This new interpretation of the buffer zone rule is an unholy reversal of the original intent of the Surface Mine Act,which wasto protect communities and streams, not bury them." The effort to repeal the buffer zone rule dates back to 2004, when OSM proposed repealing the Reagan-era rule to allow coal companies to accelerate mountaintop removal mining in Appalachia. In response to protests from coalfield residents and conservation groups, OSM agreed it would do an Environmental Impact Statement (EIS) before changing the longstanding rule. But in its new draft EIS, OSM rejected and failed to analyze all alternatives that would have restricted stream filling. In its own words, "OSM would not anticipate a major shift in on-the-ground consequences from any of the alternatives." Most egregious is that the agency did not even consider the effect of enforcing the stream buffer zone rule as written. "OSM summarily rejected all alternatives that would reduce harm and only considered those that would allow stream burials to continue at the same rate as in the past," said Jim Hecker, Environmental Enforcement Director at Public Justice. "OSM's own report shows that valley fills harm downstream water quality but this proposal does nothing to address it." The agency also assumes all stream loss will be fully mitigated, even though it freely admits that stream mitigation has generally failed. "While proven methods exist for larger stream channel restoration and creation, the state of the art in creating smaller headwater streams onsite has not reached the level of reproducible success," the OSM wrote. "Attempts to reestablish the functions of headwater streams…have achieved little success to date." "The coal companies have yet to show that they can successfully recreate streams after they completely destroy these mountains and bury these waters, yet OSM still gives them this major exemption from the law," said Dianne Bady, with the Ohio Valley Environmental Coalition. "These headwater streams are the sources of our drinking water and our heritage, and this administration is knowingly allowing them to be buried and poisoned." This wholesale exemption for mountaintop removal mining will have significant impact to downstream water quality, permanently filling and destroying important headwaters that feed larger waters that function as drinking water sources and fishing and recreational waters for thousands of Americans. Already, mountaintop removal mining has flattened more than 500,000 acres and permanently buried 2,000 miles of streams. "The OSM essentially wants to destroy our most valuable, life-giving resource to extract a filthy, polluting resource," said Vernon Haltom of Coal River Mountain Watch. "We who live near mountaintop removal sites are having our future sustainability destroyed for someone else's short-term profits." "This proposal amounts to a stamp of approval for the nation's most destructive form of coal mining," said Ed Hopkins, Director of Sierra Club's Environmental Quality program. Jeff Regardless of how we are thinking, this editorial is increasingly the way most of the rest of the country is thinking. To remain competitive, and get off the bottom of Forbes' list, we need an aggressive approach to diversify the State's economy, including the energy industry. As I have said so often, and will not let up stating, "We MUST participate, and/or even be seeking leadership roles, in the rapidly growing alternative and renewable energy technologies, including their manufacturing and jobs potential!". I am concerned that yesterday's meeting, while interesting, was not particularly helpful in considering the changes in thinking, as well as the unique future policies and actions needed for the participating in the energy dynamics, not of the past, but of the today and the future. We certainly must avoid a token, pacifying or just tolerant approach. I did not come away from the meeting with any sense of accomplishment. You will recall that Charles Bayless urged you and I to look at the Ontario Power web pages for their innovative and aggressive efforts at energy conservation and efficiency. I did, and it is quite revealing. Global Warming is real. Mandating efforts for efficiency and conservation is appropriate from the power plants on down to the consumer, residential, commercial and industrial. When is the appointment with WV Tech's Charles Bayless and faculty rescheduled, and why was it cancelled? The potential for clean safe jobs in the construction and operation of CSP plants must be investigated...the PEA made that decision several meetings ago, and the investigation is dragging on much too slowly. Progress should be reported at the next PEA Meeting, billed as the "Renewable Energy Public Hearing". We were asked again at the meeting yesterday why we are not investigating this, and no answer was provided. I don't enjoy being embarrassed. The agenda yesterday called for members to speak. We skipped that, and went to the public. It seems to me that we would be better served if we have Q&A after each speaker, and, as I tried to do yesterday, that we have a dialogue with those who speak so that they feel we are listening and value their input. But neither he nor leading Democratic politicians have ever rallied the country to break its addiction to a more lethal form of energy: coal, which supplies half the nation's electricity. This month, an accident in Utah entombed six miners, forever. Three more died trying to rescue them. Four days after the first accident, three coal miners plunged down a shaft to their deaths in an Indiana mine. In China, which has the world's worst coal-mining fatality record, 181 miners are trapped in a flooded mine shaft with little hope of survival. More than 2,000 Chinese coal miners have died in accidents this year. Then there are the respiratory conditions, including asthma, that are made worse by the sulfur dioxide, nitrogen oxide, and fine particulates emitted in coal's combustion. Coal-burning power plants are also the principal man-made source of the nerve-system poison mercury. Its buildup in many species of fish has caused the Food and Drug Administration to advise women of child-bearing age to limit consumption of that otherwise healthful source of protein. Despite such warnings, women in the United States face a 10 to 15 percent risk of bearing children with mercury levels high enough to slow their mental development. In Appalachia, mining by mountaintop removal is changing the face of the earth. Coal burning is changing the climate of the earth. Of all the fossil fuels, coal emits the most carbon dioxide, the most common greenhouse gas. Forty percent of the US total of carbon dioxide comes from coal burning, mostly to produce electricity. Gasifying coal before burning it makes it possible to capture and store carbon dioxide emissions, but the process raises the cost of the electricity produced and has yet to be tested at full scale. In the meantime, utilities in the United States and elsewhere continue to build coal-fired plants without controls on carbon dioxide. Last year alone, China built more than 90 major coal-fired power plants. Legislation passed by the US House that would force utilities to start getting more of their power from renewable sources faces an uncertain future in the Senate, where it is opposed by senators from states without ready access to renewables. The United States cannot wean itself from coal overnight. But as Congress and all Americans chart the nation's energy future, coal's environmental costs, especially its contribution to global warming, have to be factored into the equation. So do those accidents in Utah, Indiana, and China. No other energy solution -- not wind, solar, nuclear, biomass, natural gas, geothermal, and certainly not conservation and efficiency -- takes a toll in lives and environmental destruction that is at all comparable to coal's.

How do we get enough money to pay an expert witness by mid-September? I am working with national now re:foundation money, and personal donars. We have some leads, but the time will not be for September. I also know that we can do a targeted audience fund raising campaign, but we won't get close to our targeted amount of money. Idaho just began a three-year >pilot with Idaho Power in June. Minnesota, New York and Wisconsin are >studying decoupling for electric utilities. Eleven states have adopted >decoupling for their natural gas utilities. > Decoupling has its critics, especially among consumer advocates. Colleagues A couple of days ago, there was an article reporting how Governor Manchin has "finally" gat the attention of former President Bill Clinton about the need for coal to be the solution to our energy crisis." In today's Gazette, there is a report by Tim Huber of Associated Press with the headline "Support Needed for Coal To Liquid" in section A...(I clipped it...so did not get the page number). It outlines our challenge. Supporters of seeking Federal Government subsidies for funding CTL, because Wall Street won't without the Government guarantees, Congressmen Rahall and Murtha and sadly, Senator Rockefeller. Here's Rockefeller's statement, which is unbelievably wrong...but probably politically correct:. "Coal-clean coal-must be the solution for our energy needs"....It is the only solution to our energy needs. That is what is so ridiculous about all of it. It is what we have got. God gave it to us" There is total disregard for Global warming, and the economic opportunities that reversing it present. We must mount a massive two part public education effort. I have tried to outline the issues below, and bear with me, as I know all of you know the issues and alternatives. First we need to refute, and educate, with independent studies and evidence, Rockefeller's arguments: 1.. There is no clean coal technology yet developed that is commercially viable. 2.. CTL is NOT the only solution to our energy needs...by a long shot. To start with, Energy conservation and efficiency is very low hanging fruit that can dramatically cut our imported oil addiction. 3.. The widespread independent opinions about the horrors of CTL, 4.. The truth that carbon sequestration technology on the scale that will be required is not proven or viable...as the Australians have already concluded 5.. God delivers more energy every single day in sunlight than we would need, or could consume in 20+ years. We need to start with Rockefeller and the rest of the WV Delegation, (well maybe excluding Capito) and educate them that 1.. Solar energy is coming down in cost at such a rate that it will be competitive with coal by 2015. 2.. The Renewable energy industry, whether it be solar, wind or biomass and alternative fuels, but particularly the solar manufacturing industry is growing so rapidly that West Virginia is going to be in worse economic shape if it does not participate NOW 3.. Several States have already embraced the inevitable switch to renewable energy, including Murtha's Pennsylvania. 4.. There needs to be aggressive support for raising the C.A.F.E. Standards...because the battery technology exists to achieve 100 m.p.g. in a plug in Prius, so the technology to get higher gas mileage is here and emerging...so Government support needs to be focused on accelerating and incentivizing its adoption. When can we all get together and develop a strategy, and a program to counter the effort that the CTL crowd are going to make? I urge you all to see this as a major crisis requiring bold and immediate action. There are National organizations in addition to the Sierra Club that may have resources to help us. We need a ground swell of opposition to thwart this CTL crowd. And proposing alternatives will bring a positive focus to our efforts, and show that we are not opposed to jobs and economic development, quite the contrary, there are just as well paying jobs in renewable energy that are safer, (Sago, Utah Miners) , do not pollute or use our precious water and air. We all have a lot on our plates right now, I am sure. I am quite immersed in starting anew manufacturing business, that ironically, will save jet fuel in commercial airlines when brought to fruition. But stopping this CTL effort, and educating the citizens of this State that the ere are alternatives energy policies and technologies that will be better for almost everyone except the Blankenship CEO types and politicians he and his ilk have bought and paid for. I for one am ready, with my available slides and training from the Gore Climate Project, to get on the road and get "our side" of this case out there. But I cannot do it alone.... Let me hear from you all...am I just a ranting old man, (I turned 75 today), or are you with me? Timing is NOW...bring me your commitment so we can together move this effort forward...and it will be the best birthday present that I could ever want... As promised, I am pursuing funds to support our legal fees and expert witnesses re: PSC intervention. Jim Kotcon and others have been working to find expert witnesses. Both processes are slow going. I have found some money and Jim has found a potential witness. The fee this expert witness has proposed was an eye opener for me. He is talking about $20 - $30,000!!! And along with this he is not sure he can be prepared by October, which is when we might need to have our case ready (although it might be Nov or Dec.) Regardless, time is getting close and it always takes lots of time to get lots of money. I need someone (s) to step forward who is involved with neighborhood groups along the proposed power line who can serve as the Sierra energy liaison. I need this person to represent our interests to the other groups and I need this person to report back to the committee. The over-riding effort at this time is to find "like-minded" groups with whom we can share our expert witness expenses. I know several of you are involved with various groups that are strategizing for intervention. Who among us can bring these groups and our monies together? Times JAPAN SEES NUCLEAR POWER as a solution to global warming, but it's paying a price. Last week, a magnitude 6.8 earthquake caused dozens of problems at the world's biggest nuclear plant, leading to releases of radioactive elements into the air and ocean and an indefinite shutdown. Government and company officials initially downplayed the incident and stuck to the official line that the country's nuclear plants are earthquake-proof, but they gave way in the face of overwhelming evidence to the contrary. Japan has a sordid history of serious nuclear accidents or spills followed by cover-ups. It isn't alone. The U.S. government allows nuclear plants to operate under a level of secrecy usually reserved for the national security apparatus. Last year, for example, about nine gallons of highly enriched uranium spilled at a processing plant in Tennessee, forming a puddle a few feet from an elevator shaft. Had it dripped into the shaft, it might have formed a critical mass sufficient for a chain reaction, releasing enough radiation to kill or burn workers nearby. A report on the accident from the Nuclear Regulatory Commission was hidden from the public, and only came to light because one of the commissioners wrote a memo on it that became part of the public record. The dream that nuclear power would turn atomic fission into a force for good rather than destruction unraveled with the Three Mile Island disaster in 1979 and the Chernobyl meltdown in 1986. No U.S. utility has ordered a new nuclear plant since 1978 (that order was later canceled), and until recently it seemed none ever would. But rising natural gas prices and worries about global warming have put the nuclear industry back on track. Many respected academics and environmentalists argue that nuclear power must be part of any solution to climate change because nuclear power plants don't release greenhouse gases. They make a weak case. The enormous cost of building nuclear plants, the reluctance of investors to fund them, community opposition and an endless controversy over what to do with the waste ensure that ramping up the nuclear infrastructure will be a slow process — far too slow to make a difference on global warming. That's just as well, because nuclear power is extremely risky. What's more, there are cleaner, cheaper, faster alternatives that come with none of the risks. Glowing pains Modern nuclear plants are much safer than the Soviet-era monstrosity at Chernobyl. But accidents can and frequently do happen. The Union of Concerned Scientists cites 51 cases at 41 U.S. nuclear plants in which reactors have been shut down for more than a year as evidence of serious and widespread safety problems. Nuclear plants are also considered attractive terrorist targets, though that risk too has been reduced. Provisions in the 2005 energy bill required threat assessments at nuclear plants and background checks on workers. What hasn't improved much is the risk of spills or even meltdowns in the event of natural disasters such as earthquakes, making it mystifying why anyone would consider building reactors in seismically unstable places like Japan (or California, which has two, one at San Onofre and the other in Morro Bay). Weapons proliferation is an even more serious concern. The uranium used in nuclear reactors isn't concentrated enough for anything but a dirty bomb, but the same labs that enrich uranium for nuclear fuel can be used to create weapons-grade uranium. Thus any country, such as Iran, that pursues uranium enrichment for nuclear power might also be building a bomb factory. It would be more than a little hypocritical for the U.S. to expand its own nuclear power capacity while forbidding countries it doesn't like from doing the same. The risks increase when spent fuel is recycled. Five countries reprocess their spent nuclear fuel, and the Bush administration is pushing strongly to do the same in the U.S. Reprocessing involves separating plutonium from other materials to create new fuel. Plutonium is an excellent bomb material, and it's much easier to steal than enriched uranium. Spent fuel is so radioactive that it would burn a prospective thief to death, while plutonium could be carried out of a processing center in one's pocket. In Japan, 200 kilograms of plutonium from a waste recycling plant have gone missing; in Britain, 30 kilograms can't be accounted for. These have been officially dismissed as clerical errors, but the nuclear industry has never been noted for its truthfulness or transparency. The bomb dropped on Nagasaki contained six kilograms. Technology might be able to solve the recycling problem, but the question of what to do with the waste defies answers. Even the recycling process leaves behind highly radioactive waste that has to be disposed of. This isn't a temporary issue: Nuclear waste remains hazardous for tens of thousands of years. The only way to get rid of it is to put it in containers and bury it deep underground — and pray that geological shifts or excavations by future generations that have forgotten where it's buried don't unleash it on the surface. No country in the world has yet built a permanent underground waste repository, though Finland has come the closest. In the U.S., Congress has been struggling for decades to build a dump at Yucca Mountain in Nevada but has been unable to overcome fierce local opposition. One can hardly blame the Nevadans. Not many people would want 70,000 metric tons of nuclear waste buried in their neighborhood or transported through it on the way to the dump. The result is that nuclear waste is stored on-site at the power plants, increasing the risk of leaks and the danger to plant workers. Eventually, we'll run out of space for it. Goin' fission? Given the drawbacks, it's surprising that anybody would seriously consider a nuclear renaissance. But interest is surging; the NRC expects applications for up to 28 new reactors in the next two years. Even California, which has a 31-year-old ban on construction of nuclear plants, is looking into it. Last month, the state Energy Commission held a hearing on nuclear power, and a group of Fresno businessmen plans a ballot measure to assess voter interest in rescinding the state's ban. Behind all this is a perception that nuclear power is needed to help fight climate change. But there's little chance that nuclear plants could be built quickly enough to make much difference. The existing 104 nuclear plants in the U.S., which supply roughly 20% of the nation's electricity, are old and nearing the end of their useful lives. Just to replace them would require building a new reactor every four or five months for the next 40 years. To significantly increase the nation's nuclear capacity would require far more. The average nuclear plant is estimated to cost about $4 billion. Because of the risks involved, there is scarce interest among investors in putting up the needed capital. Nor have tax incentives and subsidies been enough to lure them. In part, that's because the regulatory process for new plants is glacially slow. The newest nuclear plant in the U.S. opened in 1996, after having been ordered in 1970 — a 26-year gap. Though a carbon tax or carbon trading might someday make the economics of nuclear power more attractive, and the NRC has taken steps to speed its assessments, community opposition remains high, and it could still take more than a decade to get a plant built. Meanwhile, a 2006 study by the Institute for Energy and Environmental Research found that for nuclear power to play a meaningful role in cutting greenhouse gas emissions, the world would need to build a new plant every one to two weeks until mid-century. Even if that were feasible, it would overwhelm the handful of companies that make specialized parts for nuclear plants, sending costs through the roof. The accelerating threat of global warming requires innovation and may demand risk-taking, but there are better options than nuclear power. A combination of energy-efficiency measures, renewable power like wind and solar, and decentralized power generators are already producing more energy worldwide than nuclear power plants. Their use is expanding more quickly, and the decentralized approach they represent is more attractive on several levels. One fast-growing technology allows commercial buildings or complexes, such as schools, hospitals, hotels or offices, to generate their own electricity and hot water with micro-turbines fueled by natural gas or even biofuel, much more efficiently than utilities can do it and with far lower emissions. The potential for wind power alone is nearly limitless and, according to a May report by research firm Standard & Poor's, it's cheaper to produce than nuclear power. Further, the amount of electricity that could be generated simply by making existing non-nuclear power plants more efficient is staggering. On average, coal plants operate at 30% efficiency worldwide, but newer plants operate at 46%. If the world average could be raised to 42%, it would save the same amount of carbon as building 800 nuclear plants. Nevertheless, the U.S. government spends more on nuclear power than it does on renewables and efficiency. Taxpayer subsidies to the nuclear industry amounted to $9 billion 2006, according to Doug Koplow, a researcher based in Cambridge, Mass., whose Earth Track consultancy monitors energy spending. Renewable power sources, including hydropower but not ethanol, got $6 billion, and $2 billion went toward conservation. That's out of whack. Some countries — notably France, which gets nearly 80% of its power from nuclear plants and has never had a major accident — have made nuclear energy work, but at a high cost. The state-owned French power monopoly is severely indebted, and although France recycles its waste, it is no closer than the U.S. to approving a permanent repository. Paul I apologize, but I cannot attend the ExCom Meeting. I had planned to, but have construction going on at my home that requires me to be here Saturday. Please bear with me, this memo is long and involved, but I think quite critical to action that should be considered at the ExComm. I would like to suggest that the agenda should address the stated intention of the Public Energy Authority to begin to conduct public hearings, as required by SB 177 passed this last Session, leading to the development of a Comprehensive Energy Policy and Plan, (CEPP), or as the administration is now calling it, an "Energy Opportunities" document. That should be accessed at http://www.wvdo.org/community/eep.html The plan is required by SB177 to be delivered by December 1 to the Legislature. Attached is the context of a memo from Jeff Herholdt inviting Ed Snyder to speak at the September meeting, the new Chairman of the PEA and Director of the New Department of Energy. Note that I have highlighted the date for the August meeting which will address energy efficiency. I would hope that the SC can present the case for a much more broad approach to energy efficiency and renewable energy than I believe the Manchin administration is fostering. I am trying to influence the direction as I work with the administration behind the scenes, and then as I sit publicly on the PEA. But as you all well know, our thoughts about energy efficiency and renewable energy don't start and end with the "C" word! I suggest that we need to submit ideas and a comprehensive plan for : 1. tax incentives for solar installations to consumer, commercial and industrial buildings, * 2. expansion of net metering, * 3. across the board commitment to minimum standard Energy Star and 4. L.E.E.D Certification in all buildings built with tax payers dollars as a start to energy efficient building codes, 5. Renewable Energy Portfolio Standards *...like New Mexico's Governor Richardson has proposed 6. Significantly improved C.A.F.E. Standards for all vehicles 7. Requirements for hybrid vehicles in the State Fleet.* 8. A commitment to use bio diesel in all school buses, and eventually in all State owned diesel vehicles.* In every recommendation, we should take the posture, and support it with any documentation that other States/Provinces have developed, like PA, IL, ON that these ideas will in fact increase the job opportunities, will encourage business expansion and formulation, and will increase tax revenue to the State. I have asterisked the ideas that there is very serious and high level opposition to. These are my thoughts for your consideration. I have been quite vociferous and have forced my way into a leadership role in the sub committee that wrote the first draft of the CEPP. We have never had feedback from the Governor, however, I can now see where the feedback is being channeled towards the new leadership. Please consider the above. I am on the PEA because of the requirement for one member that has demonstrated a role of environmental advocacy. I can tell you that I am however not alone. Joe Freeland of New Martinsville WV is also quite environmentally oriented. Because of him, we voted yesterday to seek the transfer of two permits to modify two flood control dams on the Ohio River and install hydro generators. So look at these ideas and possibilities.
